The Counterfeiter Hall of Shame – Pt 2: CASE STUDY

In this month’s Brand Protection Professional (BPP) issue, a case study titled, “Combating Counterfeit Medical Devices,” details the backstory of not only the charges made against the Florida woman I discussed in my previous post, but the brand’s aggressive scouring of nine countries in global pursuit of the counterfeiters.

The investigation started with a physician who recognized the deficiency of the mesh-pad while conducting brain surgery in a U.S. hospital operating room, that eventually led to not only the UAE, but a sordid apartment in Delhi where thousands of counterfeit packages were being put together.

This case study was written by Roy Albiani, Global Brand Protection/Medical Devices director for Johnson and Johnson–parent company of the surgical pad manufacturer.

INVESTIGATIVE/ENFORCEMENT STEPS

He provides a step-by-step investigative/enforcement journey from the hospital’s initial complaint:

  • to the brand’s analysis of the counterfeit
  • to the assembly of an international brand protection pursuit team
  • to aggressive civil enforcement and discovery
  • to identifying other countries around the world selling the counterfeits
  • to criminal prosecutions

This case study is a MUST read.

*Roy Albiani was the recipient of the Michigan State University, Center for Anti-Counterfeiting and Product Protection (A-CAPP) “2020 Brand Protection Hero Award.”
